Praise be to God, Lord of the Worlds, and prayers and peace be upon the Imam of the pious, the master of the messengers, sent as a mercy to the worlds, our master Muhammad and upon all his family and companions, and make us with them, and gather us in their group with your mercy, O Most Merciful of the merciful.
Know, O Muslims: that the Caliph is restricted in adopting legislation by the Sharia rulings, and it is forbidden for him to adopt a ruling that has not been correctly derived from the Sharia evidence. He is bound by the rulings he has adopted and by the method of deduction he has committed to, so it is not permissible for him to adopt a ruling that was deduced according to a method that contradicts the method he adopted, nor to give an order that contradicts the rulings he adopted. The Caliph is bound by these two matters.
Abu Rayhana (may God be pleased with him) said: We went out with the Messenger of God, peace and blessings be upon him, on a raid, and I heard him say: "The Fire is forbidden to an eye that shed tears out of fear of God, the Fire is forbidden to an eye that stayed awake in the cause of God, and I forgot the third, and I heard after that he said, the Fire is forbidden to an eye that lowered its gaze from what God has forbidden."
