With the Hadith
The Ruling on Leasing in Islam
We greet you all, dear listeners, everywhere, in a new episode of your program "With the Hadith". We begin with the best greeting: Peace, mercy, and blessings of God be upon you.
Narrated `Abdullah bin `Umar: Allah's Messenger (ﷺ) said, "Pay the worker his wage before his sweat dries."
It was mentioned in the explanation of Ibn Majah's Sunan by Al-Sindi:
His saying: (Pay the worker), meaning that it is appropriate to hasten in giving him his right after finishing the work.
His saying: (before his sweat dries), which results from engaging in the task.
Dear listeners:
Leasing is a contract for usufruct in exchange for compensation, and it includes three types:
The first type - is what the contract pertains to the benefits of properties, such as renting houses, animals, vehicles, and the like.
The second type - is what the contract pertains to the benefit of work, such as hiring craftsmen and artisans for specific tasks. What is contracted for is the benefit derived from the work, such as hiring a dyer, a blacksmith, a carpenter, and the like.
The third type - is what the contract pertains to the benefit of the person, such as hiring servants, workers, and the like.
Leasing of all kinds is permissible in Islamic law. Allah Almighty said: [And We have raised some of them above others in degrees [of rank] that they may make use of one another for service] And He said: [Then if they suckle [the children] for you, give them their due compensation] And Al-Bukhari narrated: «That the Prophet r and Al-Siddiq hired a man from Bani Al-Deel as a skilled guide».
Dear listeners, until we meet you with another prophetic hadith, we leave you in God's care, and peace, mercy, and blessings of God be upon you.
