With the Hadith
No Emigration After the Conquest
We greet you all, dear listeners, everywhere, in a new episode of your program "With the Hadith." We begin with the best greeting: Peace, mercy, and blessings of God be upon you.
From Ibn Abbas, who said: The Messenger of God, may God bless him and grant him peace, said on the day of the conquest of Mecca: "There is no emigration after the conquest, but jihad and intention, and if you are called to mobilize, then mobilize."
It is mentioned in Tuhfat Al-Ahwadhi in explaining Jami' Al-Tirmidhi
His saying: (No emigration after the conquest) i.e., the conquest of Mecca.
Al-Khattabi and others said: Emigration was an obligation in the early days of Islam on those who converted to Islam due to the scarcity of Muslims in Medina and their need to unite. When God opened Mecca, people entered the religion of God in droves, and the obligation of emigration to Medina fell away, and the obligation of jihad and intention remained on whoever undertook it or was invaded by an enemy, end quote. The wisdom in the obligation of emigration on those who converted to Islam was also to be safe from the harm of their relatives from the disbelievers, for they used to torture those who converted from them until they renounced their religion, and concerning them, the verse was revealed: {Indeed, those whom the angels take [in death] while wronging themselves - [the angels] will say, "In what [condition] were you?" They will say, "We were oppressed in the land." The angels will say, "Was not the earth of God spacious [enough] for you to emigrate therein?"} This emigration remains in effect for those who convert to Islam in the land of disbelief and are able to leave it. Al-Nasa'i narrated through Bahz bin Hakim bin Mu'awiyah from his father from his grandfather, attributed to the Prophet: "God does not accept any deed from a polytheist after he converts to Islam and separates from the polytheists." And Abu Dawood narrated from Samra, attributed to the Prophet: "I am free from every Muslim who resides among the polytheists." This is interpreted as referring to those who do not feel safe about their religion.
(But jihad and intention)
Al-Taybi and others said: This correction implies a different ruling for what follows from what precedes it. The meaning is that the emigration, which is the separation from the homeland that was required of individuals to Medina, has ceased, except that separation for the sake of jihad remains, as well as separation for a good intention, such as fleeing from the land of disbelief, going out in search of knowledge, and fleeing with religion from trials, and the intention in all of that.
(And if you are called to mobilize, then mobilize)
Al-Nawawi said: He means that the good that ceased with the cessation of emigration can be obtained through jihad and good intentions, and if the Imam commands you to go out for jihad and other righteous deeds, then go out for it.
Dear listeners:
Emigration is leaving the land of disbelief to the land of Islam. God Almighty said: (Indeed, those whom the angels take [in death] while wronging themselves - [the angels] will say, "In what [condition] were you?" They will say, "We were oppressed in the land." The angels will say, "Was not the earth of God spacious [enough] for you to emigrate therein?" For those, their refuge is Hell - and evil it is as a destination. (97) Except for the oppressed among men, women, and children who cannot devise a plan nor are they directed to a way. (98) For those, perhaps God will pardon them. And God is ever Pardoning and Forgiving. (99))
Emigration from the land of disbelief to the land of Islam remains and has not ceased. Ahmad narrated from the Prophet r that he said: "Emigration does not cease as long as there is jihad." And in another narration from him: "Emigration does not cease as long as the disbelievers are fought."
As for the ruling on emigration, it is an obligation in some cases for those who are able to do it and recommended in other cases. As for those who are unable to do it, God has forgiven them and they are not required to do it, because they are unable to emigrate either due to illness, coercion to stay, or weakness, such as women, children, and the like, as mentioned in the conclusion of the verse on emigration.
Whoever is able to emigrate but cannot show his religion or perform the required rulings of Islam, then emigration is an obligation upon him, as mentioned in the verse on emigration. (97)).
As for whoever is able to emigrate but can show his religion and perform the required rulings of Sharia, then emigration in this case is recommended and not obligatory. As for it being recommended, it is because the Messenger r used to encourage emigration from Mecca before the conquest, as it was a land of disbelief. As for it not being obligatory, it is because the Messenger r approved of those who remained in Mecca from the Muslims. It was narrated that Nu'aim Al-Nahham, when he wanted to emigrate, his people, Banu Adi, came to him and said to him: Stay with us and you are on your religion, and we will protect you from anyone who wants to harm you, and take care of what you used to take care of for us. He used to take care of the orphans and widows of Banu Adi, so he stayed away from emigration for a while, then emigrated later. The Prophet r said to him: "Your people were better for you than my people for me. My people expelled me and wanted to kill me, and your people protected you and prevented harm from you." Ibn Hajar mentioned it in Al-Isaba. He said: O Messenger of God, rather your people brought you out to obedience to God and jihad against His enemy, and my people hindered me from emigration and obedience to God.
Dear listeners, until we meet you with another Prophetic Hadith, we leave you in God's care. Peace, mercy, and blessings of God be upon you.
